These Terms of Service govern your use of SongGifty and your purchase of any SongGifty digital products or related services.
SongGifty is operated by CATALINA DIGITAL SL (NIF B19827104), established in Spain at Avenida Meridiana 2P. 6 PTA. 2. 08018, Barcelona (Barcelona). Spain. Questions about these terms can be sent to support@songgifty.com.
SongGifty allows you to submit story details, preferences, and other creative inputs so we can generate AI-assisted song previews and, after payment, deliver a full MP3 download and a shareable digital gift page. The service is digital only.
You may only use SongGifty if you can lawfully enter into a binding agreement. You are responsible for making sure the information you submit is accurate and that you have the rights or permissions needed to share names, stories, lyrics, and other materials with us.
Song previews are free unless we clearly state otherwise. The paid product price is shown at checkout and may change over time. Promo codes or discounts may be offered subject to the terms presented with that offer. Payments are processed by Stripe.
After a successful purchase, SongGifty aims to deliver the full song by email and provide access to the related gift page. Delivery is usually fast, but exact timing may vary depending on provider, network, or support conditions.
If you are unhappy with the result, contact us and we will try to make it right. That may include support help, a revised attempt where feasible, or a refund if the product cannot reasonably be brought to a satisfactory outcome. Refunds are handled in line with our support workflow and Stripe processing timelines.
SongGifty provides digital content and digital services. Because delivery and performance may begin shortly after purchase, cancellation or withdrawal rights may be limited once performance has begun where local law allows. Nothing in these terms removes any mandatory consumer rights that apply to you.
You may not use SongGifty to submit or request unlawful, hateful, discriminatory, defamatory, infringing, sexually explicit, abusive, impersonating, or otherwise rights-violating content. We may refuse, suspend, cancel, or remove content or orders that create legal, safety, payment, or platform risk.
You keep your rights in the materials you submit, but you grant SongGifty the rights needed to host, process, generate, deliver, troubleshoot, and support your order. Subject to these terms and payment, you receive a personal-use license to play, share, gift, and post the delivered song for non-commercial purposes. Commercial exploitation, resale, paid distribution, or monetized use requires separate permission.
SongGifty uses artificial intelligence and third-party providers to generate song outputs and operate delivery flows. Results may vary, and we cannot guarantee an exact style match, emotional reaction, or uninterrupted availability of any provider-backed feature.
We may update, suspend, or discontinue parts of the service at any time. We do not guarantee that SongGifty will always be available, error-free, or compatible with every device, browser, or email provider.
To the fullest extent permitted by law, SongGifty is provided as-is and our total liability for any claim relating to a paid order is limited to the amount you paid for that order. Nothing in these terms limits liability that cannot lawfully be excluded or limited under applicable law.
You agree to indemnify and hold CATALINA DIGITAL SL harmless from claims, losses, or costs arising from content you submit, your misuse of the service, or your breach of these terms.
These terms are governed by the laws of Spain, except where mandatory consumer protection laws in your country of residence apply. Any disputes will be handled in the courts that have jurisdiction under applicable law.
We may update these terms from time to time. The version posted on this page will apply from its published date unless applicable law requires additional notice.
